WKZE Concert Archive

Copyright, Intellectual Property & Takedown Policy

Effective Date: October 14, 2026
Operated by: AK22 Digital Media, LLC
Associated Services: WKZE Radio and SignalRiot
Status: Draft for Legal Review

1. Purpose of the WKZE Concert Archive

The WKZE Concert Archive is a music preservation and distribution initiative operated by AK22 Digital Media, LLC, through WKZE Radio and SignalRiot.

The archive documents live musical performances, supports independent musicians, and provides audiences with continued access to concerts and cultural events that contribute to the musical history of the Hudson Valley and surrounding communities.

Archive materials may include complete concert performances, live radio broadcasts, audio and video recordings, interviews, and related programming originally presented through WKZE, SignalRiot, or associated production partners.

The archive is intended to support musical discovery, artist exposure, and the preservation of live performance history while respecting the intellectual property rights of performers, songwriters, composers, publishers, record labels, producers, and other rights holders.

2. Copyright Ownership

All musical compositions, lyrics, arrangements, sound recordings, audiovisual recordings, photographs, and related materials appearing in the WKZE Concert Archive remain subject to applicable copyright and intellectual property laws.

Copyright ownership of underlying musical compositions and other protected works remains with their respective rights holders.

AK22 Digital Media, LLC retains the copyrights it lawfully owns in original audio and video recordings, editing, production elements, graphics, and related materials created by WKZE or SignalRiot, subject to applicable agreements and third-party rights.

The inclusion of any recording in the archive does not constitute a transfer or assignment of rights belonging to performers, composers, publishers, record labels, or other parties.

No ownership of third-party intellectual property is asserted solely by virtue of its inclusion in the archive.

3. Recording, Broadcast & Archive Permissions

WKZE and SignalRiot seek appropriate authorization for the recording, broadcasting, preservation, and distribution of concert performances.

Such authorization may be obtained through agreements with performing artists, artist management, authorized representatives, venues, event organizers, or other appropriate parties.

Permission to record or broadcast a performance does not necessarily constitute permission for subsequent on-demand distribution, video presentation, or indefinite archival availability.

Where appropriate, WKZE and SignalRiot may obtain separate permission for the recording, reproduction, editing, promotion, transmission, and on-demand presentation of concert materials.

Any distribution is subject to applicable licenses, contractual arrangements, and limitations imposed by the relevant rights holders.

4. Musical Compositions, Cover Performances & Third-Party Rights

Concert recordings may include original compositions, licensed works, arrangements, and performances of songs written or published by third parties.

Copyright ownership of these compositions remains with the respective songwriters, composers, and music publishers.

Rights associated with public performance, reproduction, distribution, synchronization, or other uses of copyrighted musical compositions may require separate authorization or licensing.

The presence of a musical composition in the archive does not imply that WKZE, SignalRiot, or AK22 Digital Media, LLC owns or controls the underlying musical work.

Artists and other parties providing recordings or authorizations are expected to identify known restrictions affecting the proposed use of their material. Such representations do not relieve AK22 Digital Media, LLC of any independent clearance obligations imposed by applicable law.

5. Authorized Use of Archive Materials

Unless expressly authorized otherwise, archive materials are provided for personal, noncommercial viewing and listening.

Except where permitted by applicable law or authorized by the appropriate rights holders, visitors may not reproduce, download, redistribute, sell, license, commercially exploit, retransmit, or incorporate archive materials into other productions.

Nothing in this policy is intended to restrict lawful uses permitted under applicable copyright law, including uses that qualify as fair use.

6. Rights Holder Concerns & Voluntary Removal Requests

WKZE and SignalRiot recognize that live performances may involve multiple parties with separate intellectual property interests.

We welcome communication from musicians, songwriters, publishers, record labels, management representatives, venues, and other rights holders regarding the presentation of their material.

Any rights holder who believes an archived performance has been presented without appropriate authorization may request a review, modification, restriction, or removal of the recording.

Requests should include:

  1. Identification of the concert, recording, or copyrighted work.
  2. A direct link to the archive material, when available.
  3. The requesting party’s name and contact information.
  4. A description of the rights claimed and the nature of the concern.
  5. Documentation of ownership or authorization, when reasonably necessary to evaluate the request.

  5. A statement consenting to the jurisdiction of the federal district court for the judicial district in which the submitting party’s address is located, or, if the address is outside the United States, any judicial district in which the service provider may be found, and agreeing to accept service of process from the original complaining party or that party’s agent.

Counter-notifications should be directed to andy@wkze.com.

Where the statutory counter-notification process applies, AK22 Digital Media, LLC will comply with applicable notification and restoration procedures under 17 U.S.C. § 512(g), including the applicable statutory time periods and exceptions.

Submission of a counter-notification does not guarantee restoration of material where independent legal, licensing, contractual, or editorial grounds justify continued removal.

9. Repeat Copyright Infringement

AK22 Digital Media, LLC maintains a policy addressing repeat copyright infringement.

To the extent that the archive permits user accounts, third-party uploads, or other user-directed submissions, AK22 Digital Media, LLC will adopt, reasonably implement, and inform applicable users of a policy providing for the termination, in appropriate circumstances, of repeat infringers.

AK22 Digital Media, LLC may suspend or terminate applicable accounts, reject submissions, restrict distribution, or remove material presenting unresolved copyright concerns.

10. Editorial & Archival Discretion

AK22 Digital Media, LLC reserves the right to edit, restrict, suspend, or remove archive materials at its discretion, subject to applicable laws, contractual obligations, and rights-holder agreements.

Such decisions may reflect copyright concerns, artist requests, technical considerations, changes in distribution permissions, or editorial determinations.

The inclusion of any artist, venue, performance, or event in the archive does not imply sponsorship, endorsement, or affiliation beyond relationships expressly identified.

11. No Transfer, License or Waiver of Rights

Nothing in this policy constitutes a transfer, assignment, waiver, or general license of intellectual property rights belonging to any artist, performer, songwriter, composer, publisher, record label, venue, or other rights holder.

Any permissions granted to WKZE, SignalRiot, or AK22 Digital Media, LLC remain subject to the specific terms of the applicable agreements.

Nothing in this policy authorizes the use of copyrighted material for which the legally required permissions or licenses have not been obtained.
